Summary of Experience:  Tried civil commitment cases pertaining to the Health & Safety Code, Title 11, Chapter 841, Civil Commitment of Sexually Violent Predators.  I appeared in court frequently and provided indigent defense for repeat sex offenders incarcerated in a Texas Department of Criminal Justice (TDCJ) prison unit who were sued by the State and alleged to be sexually violent predators having a behavioral abnormality.  I worked under limited supervision with latitude for the use of initiative and independent judgment.  I was responsible for case intake and interviewed each client to identify key problems or challenges with each case.  I performed research on the legal issues, drafted pleadings, and motions for filing with the clerk of the court; responded to the State’s discovery requests; worked with clients to craft answers to interrogatories and requests to admit; prepared discovery documents for case development and trial preparation; conducted many depositions of the State’s forensic experts and other witnesses; defended client depositions and other witnesses for the defense; and argued motions in court, including motions for summary disposition, motions to compel, motions in limine, motions regarding sanctions, and motions for new trial.

I utilized the Texas Code of Criminal Procedure and the Texas Penal Code as applicable to my client’s criminal history.  I relied on the Diagnostic and Statistical Manual of Mental Disorders (DSM-V) as applicable to my client’s mental condition(s); and I have knowledge regarding mental status examinations, psychological assessments, and behavioral abnormality evaluations.  I have knowledge regarding sexual and criminal recidivism and the risk factors and protective factors associated with each. I collected, organized and reviewed voluminous file material in preparation for depositions, pre-trial motions, trials, and post-trial motions.

Summary of Experience:  Elected to the Board of Directors by Municipal Utility District residents and selected President by the Board of Directors during a very difficult and challenging time when the Texas Water Development Board (TWDB) was in process of placing the District into receivership.  I scheduled and led Board of Directors meetings before the public and I interacted and dealt with the public in an effective and efficient manner regarding the operations of the District.  I worked closely with the District’s Engineers, Operators, Attorneys, Bookkeepers, Tax Assessors & Collectors, Financial Advisers, and Auditors. I interacted, communicated and dealt with governmental officials employed with the Texas Water Development Board, Environmental Protection Agency, TNRCC (now Texas Commission on Environmental Quality – TCEQ), Harris County Pollution Control, Harris/Galveston Subsidence District, and other governmental agencies the District reported to for governmental compliance.  I was exposed to the Texas Administrative Code, Government Code – Administrative Procedure and Practice, Texas Register, Texas Public Information Act, and the Texas Open Meetings Act.  I was the District’s spokesperson who dealt with and interviewed with the news media.
